1. Who We Are

PVMath is operated by Mohammed Ismail Pasha (Einzelunternehmen, trading as PVMath), Straubinger Strasse 1, 93055 Regensburg, Germany (contact@pvmath.com). By creating an account or using app.pvmath.com or pvmath.com (together, the “Platform”), you agree to these Terms and Conditions. If you do not agree, do not use the Platform.

2. What the Platform Does

PVMath provides an integrated software platform for ground-mount solar site screening and engineering support: project setup, solar resource and regulatory screening (SiteIQ), terrain analysis (TerrainIQ), layout generation (LayoutIQ), yield screening (YieldIQ), and economic screening (RevenueIQ), plus exportable reports and terrain/CAD files (PDF, DXF, LandXML). Outputs are generated from third-party data sources (PVGIS, Copernicus/SRTM DEM, OpenStreetMap) and automated calculations.

The Platform provides preliminary, early-stage screening outputs only. It is a decision-support tool for the early phases of project development and does not replace a bankable energy yield assessment, geotechnical survey, RTK/topographic survey, or detailed engineering design by a qualified professional. You are solely responsible for independently verifying all outputs before relying on them for investment, financing, permitting, or construction decisions.

3. Accounts and Plans

• You must provide an accurate email address to create an account and are responsible for keeping your login credentials secure. Login credentials are personal to the named seat holder; sharing a single login between multiple individuals is a breach of these Terms and may result in suspension or termination of the account, regardless of whether usage limits are exceeded.
• Paid plans include unlimited project analyses. Plans are limited by the number of named seats, not by usage. Current plans are Solo (1 seat), Starter (2 seats included, additional seats available), Team (6 seats included, additional seats available), and Enterprise (unlimited seats, flat site licence), billed as described on pvmath.com. A seat is one named individual user; seats may be reassigned when a person leaves your organisation, but may not be shared concurrently between individuals.
• Trials. A time-limited evaluation may be granted at our discretion. Trial access ends automatically on the expiry date without further notice. Your account, saved projects, and previously generated results remain accessible after expiry; running new analyses and generating new exports requires a paid plan.
• Exports. The PVMath report (PDF) and project package (ZIP), including DXF and LandXML files and a PVsyst input file for import into PVsyst, require a paid plan or an active trial — see our Refund Policy for subscription terms. PVMath does not run PVsyst simulations and does not produce PVsyst results.
• PVMath may adjust plan limits, features, or pricing prospectively; changes will be reflected on the pricing page.
• We reserve the right to suspend or terminate accounts that abuse the free tier, attempt to circumvent usage limits, or violate these Terms.

4. Acceptable Use

You agree not to:

• Use automated means (scripts, bots, scraping) to bypass usage limits or extract data at scale without written permission;
• Resell, sublicense, or redistribute Platform access or outputs as a competing service;
• Reverse-engineer, decompile, or attempt to extract the underlying source code or models;
• Use the Platform to violate any applicable law or third party's rights;
• Misrepresent Platform outputs as a substitute for licensed engineering, surveying, or financial advice.

5. Your Data and Content

You retain ownership of the project data you input (site coordinates, boundaries, project names, parameters). As described in our Privacy Policy, saved projects and account data are stored in Supabase. We store a monthly usage counter to enforce plan limits. You grant us a limited license to process your input solely to generate and return the requested outputs.

6. Intellectual Property

The Platform, its software, design, branding, and documentation are the property of PVMath / Mohammed Ismail Pasha and protected by copyright and other intellectual property laws. These Terms do not grant you any rights to PVMath's trademarks, logos, or source code. Reports and export files (PDF, DXF, LandXML) generated for your own projects are yours to use for those projects.

7. Third-Party Data and Services

The Platform relies on third-party data providers (EU PVGIS/JRC, Copernicus/SRTM DEM via OpenTopoData, OpenStreetMap/Nominatim) and infrastructure providers (Supabase, Railway, Cloudflare Pages, Formspree, Brevo). PVMath does not control and is not responsible for the accuracy, availability, or continuity of these third-party services. Outages or data-quality issues at these providers may affect Platform availability or output accuracy.

8. Disclaimer of Warranties

The Platform and all outputs are provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement. Solar resource, terrain, capacity, and yield outputs are preliminary engineering screening estimates based on automated calculations and third-party datasets; they are not certified, bankable, or guaranteed figures. RevenueIQ outputs (CAPEX bands, IRR, LCOE, payback) are indicative financial screening only and do not constitute investment, tax, or financial advice.

9. Limitation of Liability

9.1 Excluded damages. To the maximum extent permitted by law, PVMath and Mohammed Ismail Pasha shall not be liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits, revenue, savings, data, goodwill, tender opportunities, or business opportunity, arising from your use of, or inability to use, the Platform — including any decision made, delayed, or foregone on the basis of screening outputs, layouts, yield estimates, or economic figures produced by the Platform.

9.2 Liability cap. Our total aggregate liability for all claims relating to the Platform, whether in contract, tort (including negligence), or otherwise, is limited to the total amount you actually paid us in the twelve (12) months immediately preceding the event giving rise to the claim, or €100, whichever is greater.

9.3 Screening-grade outputs. The Platform produces pre-engineering, screening-grade results. They are not bankable energy assessments, not surveyed topography, and not stamped civil, structural, or electrical design. You remain solely responsible for verifying every output through appropriate detailed engineering, survey, and professional review before relying on it for tender, procurement, construction, or financing decisions.

9.4 Business customers. Where you use the Platform in the course of a trade, business, craft, or profession (Unternehmer within the meaning of § 14 BGB), the limitations in this section apply in full.

9.5 Mandatory liability. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable German or EU law — in particular liability for intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for injury to life, body, or health, under the German Product Liability Act (Produkthaftungsgesetz), or arising from the culpable breach of an essential contractual obligation (Kardinalpflicht), in which case liability is limited to the foreseeable damage typical for this type of contract.

9a. Haftungsbeschränkung — verbindliche deutsche Fassung

Bei Abweichungen zwischen der englischen und der deutschen Fassung dieses Abschnitts ist die deutsche Fassung maßgeblich.

9a.1 Ausgeschlossene Schäden. Soweit gesetzlich zulässig haften PVMath und Mohammed Ismail Pasha nicht für mittelbare Schäden, Folgeschäden, Sonder- oder Strafschadenersatz sowie nicht für entgangenen Gewinn, entgangene Einnahmen oder Einsparungen, Datenverlust, Rufschädigung, entgangene Ausschreibungs- oder Geschäftschancen, die aus der Nutzung oder Nichtnutzbarkeit der Plattform entstehen — einschließlich Entscheidungen, die auf Grundlage von Screening-Ergebnissen, Layouts, Ertragsabschätzungen oder Wirtschaftlichkeits- kennzahlen der Plattform getroffen, verzögert oder unterlassen wurden.

9a.2 Haftungshöchstbetrag. Die Gesamthaftung für alle Ansprüche im Zusammenhang mit der Plattform — gleich ob aus Vertrag, Delikt (einschließlich Fahrlässigkeit) oder auf sonstiger Rechtsgrundlage — ist auf den Betrag begrenzt, den Sie in den zwölf (12) Monaten unmittelbar vor dem schadensauslösenden Ereignis tatsächlich an uns gezahlt haben, mindestens jedoch 100 €.

9a.3 Screening-Charakter der Ergebnisse. Die Plattform liefert Ergebnisse auf Vorplanungs- und Screening-Niveau. Sie stellen keine bankfähige Ertragsprognose, keine vermessene Geländeaufnahme und keine geprüfte Tragwerks-, Tiefbau- oder Elektroplanung dar. Die Verantwortung für die Überprüfung sämtlicher Ergebnisse durch geeignete Detailplanung, Vermessung und fachliche Prüfung vor einer Verwendung für Ausschreibungs-, Beschaffungs-, Bau- oder Finanzierungsentscheidungen liegt allein bei Ihnen.

9a.4 Unternehmer. Bei Nutzung der Plattform in Ausübung einer gewerblichen oder selbständigen beruflichen Tätigkeit (Unternehmer im Sinne des § 14 BGB) gelten die vorstehenden Beschränkungen uneingeschränkt.

9a.5 Zwingende Haftung. Unberührt bleibt die Haftung für Vorsatz und grobe Fahrlässigkeit, für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, nach dem Produkthaftungsgesetz sowie bei schuldhafter Verletzung wesentlicher Vertragspflichten (Kardinalpflichten); in letzterem Fall ist die Haftung auf den vertragstypischen, vorhersehbaren Schaden begrenzt.

9b. Our Role Under Data Protection Law

9b.1 We act as a controller, not as your processor. The only personal data PVMath holds is the account data of the individuals who use the Platform — name, email address, and plan status. We determine the purposes and means of processing that data ourselves: authenticating logins, enforcing plan entitlements, invoicing, and providing support. We therefore act as a controller under Article 4(7) GDPR in respect of that data, on the legal basis of contract performance (Article 6(1)(b) GDPR).

9b.2 Project data is not personal data. What you enter and store on the Platform is geospatial and technical: site coordinates, parcel boundaries, slope and terrain figures, layout geometry, capacity, yield, and economic parameters. This does not identify natural persons. We do not collect or store landowner names, addresses, or any other third-party personal data, and we ask that you do not enter such data into free-text fields.

9b.3 Consequence. Because we do not process personal data on your behalf or on your instructions, the requirement in Article 28 GDPR for a data processing agreement (Auftragsverarbeitungsvertrag) does not arise between us in the ordinary course. Our handling of account data is described in full in our Privacy Policy, including the sub-processors we rely on and where data is stored.

9b.4 Team invitations. If you invite a colleague by email, we receive that email address in order to send the invitation and create the account. We act as controller for that data from the point of receipt and use it for no other purpose. You are responsible for having a proper basis for sharing a colleague’s address with us.

9b.5 If your organisation requires one anyway. Some data protection teams require a processing agreement as a matter of internal policy regardless of the analysis above. Write to contact@pvmath.com and we will work through it with you.

9c. Datenschutzrechtliche Rolle — deutsche Fassung

9c.1 PVMath verarbeitet ausschließlich die Kontodaten der Personen, die die Plattform nutzen (Name, E-Mail-Adresse, Plan-Status). Über Zwecke und Mittel dieser Verarbeitung entscheiden wir selbst — Authentifizierung, Durchsetzung der Plan-Berechtigungen, Rechnungs- stellung und Support. Wir handeln insoweit als Verantwortlicher im Sinne des Art. 4 Nr. 7 DSGVO auf Grundlage der Vertragserfüllung (Art. 6 Abs. 1 lit. b DSGVO).

9c.2 Die von Ihnen eingegebenen Projektdaten — Koordinaten, Flurstücks- grenzen, Hangneigungen, Layout-Geometrie, Leistung, Ertrag und Wirtschaftlichkeitsparameter — sind geografische und technische Daten und keine personenbezogenen Daten. Namen oder Anschriften von Grundstückseigentümern werden nicht erhoben oder gespeichert; bitte geben Sie solche Daten auch nicht in Freitextfelder ein.

9c.3 Da wir keine personenbezogenen Daten in Ihrem Auftrag oder nach Ihren Weisungen verarbeiten, entsteht zwischen uns im Regelfall keine Auftragsverarbeitung im Sinne des Art. 28 DSGVO; ein Auftragsverarbeitungsvertrag (AVV) ist daher grundsätzlich nicht erforderlich. Einzelheiten zur Verarbeitung der Kontodaten, zu den eingesetzten Unterauftragnehmern und zum Speicherort finden Sie in unserer Datenschutzerklärung.

9c.4 Laden Sie eine Kollegin oder einen Kollegen per E-Mail ein, erhalten wir diese E-Mail-Adresse, um die Einladung zu versenden und das Konto anzulegen. Wir sind ab Zugang Verantwortlicher für diese Daten und verwenden sie zu keinem anderen Zweck. Für eine zulässige Weitergabe der Adresse sind Sie verantwortlich.

9c.5 Verlangt Ihre Datenschutzabteilung unabhängig davon eine vertragliche Regelung, schreiben Sie uns an contact@pvmath.com — wir finden gemeinsam eine Lösung.

10. Changes to the Platform and Terms

We may update these Terms from time to time to reflect changes to the Platform, pricing, or legal requirements. We will post the updated version here with a new “Last updated” date. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

11. Termination

You may stop using the Platform and delete your account at any time by contacting contact@pvmath.com. We may suspend or terminate your access for breach of these Terms, non-payment, or misuse, with notice where reasonably possible.

12. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict-of-law principles. Where you are a consumer resident in the EU, mandatory consumer-protection provisions of your country of residence remain unaffected. Any disputes shall be subject to the exclusive jurisdiction of the courts of Regensburg, Germany, to the extent permitted by law.
